مقدمة
تسعى دائرة الشؤون القانونية لحكومة دبي ("الدائرة") إلى استقطاب كفاءات طموحة للعمل ضمن قسم شؤون الترخيص بإدارة شؤون المحامين والمستشارين القانونيين، والمساهمة في تنفيذ مهام واختصاصات القسم وفقاً للتشريعات واللوائح والإجراءات المعتمدة.
المهام والمسؤوليات الرئيسية
- مراجعة وتحليل الحالات والمخالفات المرصودة عبر الأنظمة والمنصات والقنوات التقنية المعتمدة، والتحقق من مدى تشكيلها مخالفة للتشريعات والضوابط المنظمة لممارسة المهن القانونية.
- فحص المخالفات المرصودة تقنياً وتكييفها قانونياً، وتحديد الوصف القانوني المناسب لها وفقاً للتشريعات واللوائح والقرارات المعمول بها.
- مراجعة الأدلة والبيانات والمستندات الإلكترونية المتعلقة بالمخالفات، والتحقق من كفايتها وسلامتها لدعم الإجراءات القانونية المتخذة بشأنها.
- إعداد وصياغة محاضر التفتيش وضبط المخالفات المتعلقة بالمخالفات المرصودة تقنياً وفقاً للنماذج والإجراءات المعتمدة، واستكمال البيانات والمستندات والأدلة المرتبطة بها، وتسجيلها وتحديثها في الأنظمة المعتمدة.
- متابعة الإجراءات القانونية المترتبة على المخالفات المرصودة، بما في ذلك إحالتها إلى الجهات أو الوحدات التنظيمية المختصة، ومتابعة الإجراءات المتخذة بشأنها وفقاً للإجراءات المعتمدة.
- إعداد وإصدار الإخطارات الرسمية للمخالفين ومتابعة الإجراءات المترتبة على المخالفات، بما في ذلك تحصيل الغرامات إن وجدت، وتوثيق الإجراءات والنتائج في السجلات والأنظمة المعتمدة.
- رصد وتحليل الأنماط المتكررة أو المستحدثة للمخالفات، وإعداد التقارير والإحصاءات ذات الصلة، واقتراح التدابير القانونية أو التنظيمية التي تسهم في الحد منها.
- إجراء البحوث والدراسات القانونية المتعلقة بالممارسات والمخالفات المرصودة، والاستفادة من نتائجها في إعداد الآراء والتوصيات القانونية ذات الصلة.
- تنفيذ الزيارات الميدانية المجدولة أو العاجلة لمكاتب المحاماة والاستشارات القانونية المرخصة، وكذا المواقع أو الجهات المشتبه بممارستها للنشاط دون ترخيص، للتحقق من الالتزام بالتشريعات واللوائح والقرارات والتعليمات المعمول بها.
- رصد وتوثيق المخالفات والتجاوزات المهنية أو السلوكية المكتشفة أثناء الزيارات الميدانية، وجمع وتوثيق الأدلة والمستندات ذات الصلة، وإعداد تقارير الزيارة والتفتيش ومحاضر المخالفات وفقاً للإجراءات المعتمدة.
- إعداد المذكرات بشأن الموضوعات والمخالفات المحالة من مدير الإدارة أو رئيس القسم أو نائب رئيس القسم، وذلك من خلال دراسة الموضوع، وجمع وتحليل البيانات والمعلومات ذات الصلة، وصياغة المذكرات بأسلوب مهني يتضمن الوقائع، والأسانيد القانونية، والرأي، والتوصيات، والإجراءات المقترحة.
- تحديث ومتابعة بيانات مكاتب المحاماة والاستشارات القانونية غير المرخصة التي يتم رصدها من قبل الدائرة، وتحديث الجداول والأنظمة المستخدمة لمتابعة أوضاعها والإجراءات المتخذة بشأنها، بما في ذلك الأنظمة الإلكترونية ذات الصلة.
- استقبال استفسارات المتعاملين والرد عليها عبر قنوات التواصل المعتمدة، والاجتماع بالمتعاملين عند الحاجة، وتزويدهم بالملاحظات والإرشادات اللازمة وفقاً للتشريعات والإجراءات المعتمدة.
- إعداد المقارنات المعيارية والدراسات المقارنة المتعلقة بترخيص وتنظيم مكاتب المحاماة والاستشارات القانونية وممارسة المهن القانونية، ودراسة أفضل الممارسات المحلية والإقليمية والدولية، وتحديد فرص التحسين والتطوير واقتراح التوصيات المناسبة.
- المساهمة في دراسة واقتراح إعداد وتعديل وتحديث اللوائح والتشريعات ذات الصلة باختصاصات القسم، بما في ذلك اللوائح المنظمة لقيد المستشارين القانونيين وترخيص مكاتب الاستشارات القانونية، وتقديم الملاحظات والمقترحات بشأنها.
- اقتراح التحديثات والتحسينات اللازمة على نظام المهن القانونية (LPS) بالتنسيق مع الوحدات التنظيمية المعنية، ومراجعة رحلة المتعامل والخدمات المقدمة عبر النظام، وتحديد فرص التحسين التي تسهم في تبسيط الإجراءات وتعزيز كفاءة وجودة الخدمات.
- المبادرة بتقديم مقترحات التحسين والتطوير المتعلقة بعمل القسم، ومتابعة تنفيذ المقترحات القابلة للتطبيق وفقاً للإجراءات المعتمدة لدى الدائرة.
- المشاركة في اللجان وفرق العمل ذات الصلة، وتقديم الدعم القانوني والفني لفريق طلبات الترخيص.
- القيام بأي مهام أخرى ذات صلة بطبيعة الوظيفة يكلف بها من قبل المسؤول المباشر أو مدير الإدارة أو مدير عام الدائرة.

المؤهلات الأكاديمية وسنوات الخبرة
- درجة البكالوريوس في القانون أو ما يعادلها، مع خبرة عملية تزيد عن سنة وحتى أربع سنوات؛ أو
- درجة الماجستير في القانون أو ما يعادلها، مع خبرة عملية تقل عن سنة وحتى ثلاث سنوات.

- المعرفة بالتشريعات واللوائح والقرارات المنظمة لممارسة المهن القانونية وترخيص مكاتب المحاماة والاستشارات القانونية.

Job description
Introduction
The Government of Dubai Legal Affairs Department (the “Department”) is seeking to recruit ambitious professionals to work within the Licensing Affairs Section of the Lawyers and Legal Consultants Affairs Department, contributing to the implementation of the Section’s duties and responsibilities, in accordance with the applicable legislation, regulations, and approved procedures.
Key Duties and Responsibilities
- Review and analyze cases and violations identified through approved systems, platforms, and technical channels, and verify the extent to which they constitute violations of the legislation and controls governing the practice of legal professions.
- Examine and legally classify technically identified violations, and determine the appropriate legal description thereof in accordance with the applicable legislation, regulations, and decisions.
- Review evidence, data, and electronic documents related to violations, and verify their sufficiency and integrity to support the legal procedures taken in relation thereto.
- Prepare and draft inspection and violation reports related to technically identified violations in accordance with the approved templates and procedures, complete the related data, documents, and evidence, and record and update them in the approved systems.
- Follow up on the legal procedures resulting from identified violations, including referring them to the competent authorities or regulatory units, and follow up on the actions taken in accordance with the approved procedures.
- Prepare and issue official notifications to violators and follow up on the procedures resulting from violations, including the collection of fines where applicable, and document the procedures and results in the approved records and systems.
- Monitor and analyze recurring or emerging patterns of violations, prepare relevant reports and statistics, and propose legal or regulatory measures that contribute to reducing them.
- Conduct legal research and studies related to identified practices and violations, and utilize their findings in preparing relevant legal opinions and recommendations.
- Conduct scheduled or urgent field visits to licensed law firms and legal consultancy offices, as well as locations or entities suspected of conducting the activity without a license, to verify compliance with the applicable legislation, regulations, decisions, and instructions.
- Monitor and document professional or conduct-related violations and breaches identified during field visits, collect and document relevant evidence and documents, and prepare visit, inspection, and violation reports in accordance with the approved procedures.
- Prepare memoranda concerning matters and violations referred by the Department Manager, Section Manager, or Assistant Section Manager, by studying the matter, collecting and analyzing relevant data and information, and professionally drafting memoranda covering the facts, key issues, legal grounds, opinion, recommendations, and proposed actions.
- Update and follow up on the data of unlicensed law firms and legal consultancy offices identified by the Department, and update the tables and systems used to monitor their status and the actions taken in relation thereto, including relevant electronic systems.
- Receive customer inquiries and respond through approved communication channels, meet with customers when required, and provide them with the necessary information and guidance in accordance with the applicable legislation and approved procedures.
- Prepare benchmarking and comparative studies related to the licensing and regulation of law firms and legal consultancy offices and the practice of legal professions, study local, regional, and international best practices, identify opportunities for improvement and development, and propose appropriate recommendations.
- Contribute to studying and proposing the preparation, amendment, and updating of regulations and legislation relevant to the Section’s responsibilities, including regulations governing the registration of legal consultants and licensing of legal consultancy offices, and provide comments and proposals thereon.
- Propose the necessary updates and improvements to the Legal Professions System (LPS) in coordination with the relevant regulatory units, review the customer journey and services provided through the system, and identify opportunities for improvement that contribute to simplifying procedures and enhancing the efficiency and quality of services.
- Take the initiative to provide improvement and development proposals related to the Section’s work, and follow up on the implementation of applicable proposals in accordance with the procedures approved by the Department.
- Participate in relevant committees and working groups, and provide legal and technical support to the Licensing Applications Team.
- Perform any other duties related to the nature of the position as assigned by the direct supervisor, Department Manager, or Director General.
Key Administrative Duties and Responsibilities
- Comply with the information security policies approved by the Department.
- Comply with all circulars issued by the Department regarding attendance and working hours, ensuring that assigned tasks are completed within the required time, quality, and efficiency standards.
Academic Qualifications and Years of Experience
- Bachelor’s degree in Law or equivalent, with more than one year and up to four years of practical experience; or
- Master’s degree in Law or equivalent, with less than one year and up to three years of practical experience.
Required Skills (Technical and Behavioral Competencies)
- Knowledge of the legislation, regulations, and decisions governing the practice of legal professions and the licensing of law firms and legal consultancy offices.
- Ability to legally analyze and classify violations, review the related evidence, data, and documents, and prepare relevant inspection reports, memoranda, and legal drafting.
- Knowledge of using the Legal Professions System (LPS) and relevant technical systems and platforms related to licensing procedures and the monitoring and follow-up of violations.
- Ability to conduct legal research and studies, benchmarking and comparative studies, analyze data, and prepare relevant reports and statistics.
- Ability to apply legal thinking and analysis, study problems and challenges, and propose appropriate solutions and recommendations.
