<ul><li><p>المسمى الوظيفي: أخصائي منازعات إيجارية ومستشار قانوني (Rental Dispute Specialist & Legal Counsel)</p><p>مقر العمل: دبي / الشارقة (يغطي الإمارتين)</p><p>نوع العمل: دوام كامل</p><p>التقارير إلى: الإدارة العليا مباشرة</p><p>نظرة عامة على الدور:</p><p>نحن نبحث عن مستشار قانوني عقاري هجومي واستراتيجي، يمتلك خبرة عميقة وحصرية في إدارة المنازعات الإيجارية للمساحات التجارية والصناعية والمستودعات في إمارتي دبي والشارقة. لن تكون مجرد باحث قانوني، بل ستكون الدرع الأول لحماية المحفظة العقارية للمؤسسة. ستتولى إدارة ملفات الإخلاء، تحصيل المديونيات المتعثرة، صياغة العقود الصارمة، وتمثيل المؤسسة بشكل كامل أمام لجان ومراكز فض المنازعات والدوائر الحكومية لضمان سير العمليات التشغيلية دون انقطاع وبأقل مخاطر ممكنة.</p><p>المسؤوليات الرئيسية:</p><ol><li><p>التقاضي وفض المنازعات:</p></li></ol><p>تمثيل المؤسسة بشكل كامل وحصري أمام مركز فض المنازعات الإيجارية بدبي (RDC) ولجنة فض المنازعات الإيجارية ببلدية الشارقة.</p><p>فتح ومتابعة وإغلاق قضايا الإخلاء، المطالبات المالية، وقضايا الأمور المستعجلة (بما في ذلك إجراءات الحجز على المنقولات للمستأجرين المتهربين).</p><p>تسريع إجراءات تنفيذ الأحكام العقارية ومتابعتها بدقة لضمان استرداد الأصول في أسرع وقت.</p><ol><li><p>الصياغة التعاقدية ونقل المخاطر:</p></li></ol><p>صياغة وتحديث عقود الإيجار (خاصة نماذج العقود الصافية Triple Net Leases - NNN) للمستودعات والمساحات التجارية لضمان نقل التزامات الصيانة والتراخيص الحكومية (مثل الدفاع المدني) إلى المستأجرين].</p><p>إعداد ملاحق العقود وتوجيه الإنذارات العدلية والإشعارات القانونية بشكل استباقي.</p><ol><li><p>الامتثال والتمثيل الحكومي:</p></li></ol><p>إدارة وتحديث ملفات التراخيص العقارية والضرائب، وضمان عدم تعرض المؤسسة لأي غرامات بلدية أو تشغيلية تتعلق بالأملاك المدارة.</p><p>التنسيق المباشر والفعال مع الجهات المختصة مثل الشرطة، الدفاع المدني، والدوائر الاقتصادية أثناء إجراءات الإخلاء أو النزاعات.</p><ol><li><p>إدارة الأنظمة والتقارير:</p></li></ol><p>التوثيق الفوري والدقيق لجميع حالات النزاع والمواعيد النهائية لجلسات المحاكم ضمن متتبعات قضايا آلية (Litigation Trackers) وأنظمة المؤسسة الداخلية لضمان اطلاع الإدارة المستمر [1.2.3، 1.3.3].</p><p>المؤهلات والمتطلبات الأساسية:</p><p>شهادة بكالوريوس في القانون (LLB أو ما يعادلها).</p><p>خبرة لا تقل عن 5 إلى 7 سنوات كمحامٍ أو مستشار قانوني أو باحث قانوني داخل دولة الإمارات، ويفضل بشدة من لديه خبرة سابقة في مكاتب المحاماة الكبرى المتخصصة في العقارات [1.1.1، 1.2.3].</p><p>معرفة عميقة جداً بقوانين الإيجارات، وإجراءات المحاكم، وأنظمة (RDC) في دبي والشارقة.</p><p>مهارات استثنائية في صياغة العقود والمذكرات القانونية [1.2.3، 1.3.3].</p><p>احترافية عالية في إدارة الوقت والتعامل مع الأنظمة التقنية وجداول تتبع القضايا.</p><p>طلاقة تامة في اللغتين العربية والإنجليزية (تحدثاً وكتابة).</p><p>ماذا نقدم؟</p><p>بيئة عمل تعتمد على الأتمتة والكفاءة (بعيداً عن البيروقراطية).</p><p>راتب أساسي تنافسي يعتمد على الخبرة.</p><p>هيكل حوافز هجومي: مكافآت ونسب مجزية مرتبطة بسرعة إنجاز قضايا الإخلاء وتحصيل المديونيات الصعبة.</p></li></ul><p><strong>Desired Candidate Profile</strong></p><ul><li><p>degree from an accredited law school.</p></li><li><p>Active license to practice law in the relevant jurisdiction.</p></li><li><p>Minimum of 5 years of dedicated experience in landlord-tenant law or real estate litigation.</p></li><li><p>Proven track record of successfully handling complex lease negotiations and dispute resolutions.</p></li></ul>

<ol><li><p>Supervise daily labor, carpenters, painters, tile setters, and MEP technicians to ensure tasks are completed on time.</p></li><li><p>Ensure all finishing works (ceiling, flooring, joinery, wall finishes) follow approved drawings and mockup samples.</p></li><li><p>Maintain strict quality control to prevent rework, poor craftsmanship, or damage to completed areas.</p></li><li><p>Verify incoming materials on site against approved orders and store them safely to prevent damage or waste.</p></li><li><p>Coordinate daily tool and equipment requirements for on-site crews.</p></li><li><p>Report material shortages or delivery delays to the Engineer immediately.</p></li><li><p>Enforce site safety rules (PPE usage, safe handling of tools/scaffolding) and maintain clean working conditions.</p><br></li></ol><p><strong>Desired Candidate Profile</strong></p><ol><li><p>Direct site workforce supervision & trade execution</p></li><li><p>Eye for finishing detail, trade craft control, crew discipline</p></li><li><p>2+ years of practical site supervision in fit out works</p></li><li><p>Mandatory valid UAE driving license</p></li></ol>
